Attorneys for Sean “Diddy” Combs anticipate that the music mogul could receive a two-year prison sentence following his conviction on two counts of transportation to engage in prostitution, handed down on Wednesday, July 2.
The expected sentence is significantly lighter than the 51 to 63 months (over four years) recommended by federal prosecutors.
Both legal teams outlined their positions in letters to U.S. District Judge Arun Subramanian, who is overseeing the case. Combs has already spent 10 months in custody.
Combs was acquitted of the more serious charges of sex trafficking and racketeering conspiracy. He had been accused of trafficking two former girlfriends—Casandra “Cassie” Ventura and another woman known by the pseudonym “Jane”—and coercing them into drug-fueled sexual encounters, which he allegedly called “freak offs” or “hotel nights.” Combs has consistently denied the allegations, maintaining that all encounters were consensual.
In their letter to the judge, Combs’ attorneys assured the court that, if released on bond, he would not contact escorts or prostitutes. They requested his release on $1 million bond, co-signed by his mother, sister, and Sarah Chapman, the mother of his oldest daughter, Chance.
Prosecutors, however, urged the judge to deny bail, arguing that Combs remains a danger to the community. They cited an alleged assault on “Jane” in June 2024, while Combs was aware of the ongoing federal investigation, as well as claims that he was in possession of drugs and items linked to a potential “freak off” while awaiting his arrest in New York.
Combs’ legal team rejected these claims, arguing that such suggestions were unfounded and unsupported. They noted that during a period of active surveillance, Combs never made any attempt to contact escorts or arrange illicit meetings.
Although the two charges carry a maximum sentence of up to 20 years in prison (10 years per count), Combs’ lawyers believe reasonable conditions could both allow for bail and ensure he poses no further risk.
